2. Definitions

2.1
Online Store: BABYCHICKATELIER website. This includes, first and foremost, information about products available for sale, prices, discounts, shipping rates, and General Conditions of Sale. Through this website, customers can place orders and request quotes. Customers can also register on the platform and obtain a username and password to access the reserved area, where they can place orders and request quotes.

3. Privacy Policy

BABYCHICKATELIER collects customer personal data for account management, billing, and information provision, subject to customer authorization. The company is committed to privacy and security in the processing and maintenance of this data, in accordance with Regulation (EU) 2016/679 (General Data Protection Regulation). 4. Prices and Products

4.1 The products presented in the online store are sold by BABYCHICKATELIER. However, their stock status may vary depending on internal orders with suppliers.

4.2 Prices in the online store are in Euros (€), expressed per unit of measurement. They may change without prior notice, up until the time of payment, which may consequently cancel the order. BABYCHICKATELIER reserves the right to accept or reject the order.

4.3 Shipping and transaction commission costs may be added to the prices.

4.4 BABYCHICKATELIER may change prices and specifications without prior notice. However, once the order is confirmed, prices remain unchanged.

4.5 Applicable discounts, when available, are displayed in the customer’s reserved area and are valid for each order and while inventory is still in stock.

5. Order

5.1 Order Request

5.1.1 Only registered users with delivery and billing addresses in mainland Portugal can place orders in the online store. For orders in other locations, orders are subject to consultation. BABYCHICKATELIER reserves the right to accept registration requests on the website only if the user provides truthful and consistent information and if the delivery address is in mainland Portugal (for other locations, upon consultation).

5.1.2 To ensure greater accuracy, warranty, and quality of information, orders not placed through the online store must be formalized in writing and sent to geral@babychickatelier.com. Orders must clearly specify the products, quantities, and delivery location.

5.1.3 By formalizing the order, the customer/user declares that he/she accepts the General Conditions of Sale, the price list and the shipping prices available in the online store.

5.1.4 The B2C customer accepts the order by formalizing the purchase and making payment.

5.1.5 If a product is not available, BABYCHICKATELIER will inform the customer/user and refund the amounts paid within 10 (ten) days after becoming aware of the unavailability.

5.1.6 BABYCHICKATELIER reserves the right not to accept an order if it considers that there is misconduct on the part of the customer or inconsistency in the personal data registered.

5.2 Order Delivery

5.2.1 Orders placed on the website’s online store will be shipped by carrier, except when picked up at BABYCHICKATELIER’s facilities.

5.2.2 Delivery times for goods are, first and foremost, indicative and are defined in each item’s availability information. If an order includes items with different delivery times, the longer delivery time will apply to the entire order.

5.2.3 Custom-made products have variable delivery times, depending on the type and quantity of the item.

5.2.4 Orders from B2C customers in the online store that include unavailable and out-of-stock items will only be shipped when all items are available, unless the customer requests separate shipments.

5.2.5 BABYCHICKATELIER reserves the right to refuse orders containing small quantities of products whose delivery in good condition cannot be guaranteed.

5.2.6 Upon delivery of the goods, the customer or the person designated by them to receive the goods must confirm the external condition of the packaging and certify receipt of all specified quantities. If there is any discrepancy, the customer must notify the delivery entity and, within one day, inform BABYCHICKATELIER in writing, explaining the situation in detail and signing the delivery note. BABYCHICKATELIER is not liable to the carrier if the delivery note is not completed correctly.

5.2.7 BABY CHICK ATELIER is not responsible for delays in deliveries caused by force majeure or unforeseen circumstances, such as breakdowns or strikes.

5.2.8 Delivery conditions for locations outside mainland Portugal will be negotiated and defined for each order.

5.2.9 When transportation is carried out by the customer or a third party hired by him, the products are his responsibility after leaving BABYCHICKATELIER’s premises.

5.2.10 BABYCHICKATELIER reserves the right to change delivery conditions in specific and justified cases.

6. Delivery Costs

Pickup at the facility: Free of charge

Delivery in mainland Portugal: €9.00 (for orders under €250). Free shipping for orders over €250..

Delivery to other locations (outside mainland Portugal): On request

7. Payment Conditions

All orders placed on our platform are paid in advance, by credit card, PAYPAL debit card, ATM or bank transfer.

8. Exchanges, Returns and Order Cancellation

8.1 Conditions for Material Exchanges

8.1.1 The Customer has a period of ten (10) days from the date of receipt of the order to exercise their right to exchange or return, if the product does not correspond to what was intended.

8.1.2 The product must be in perfect condition, in its original sealed packaging, and with all manuals and accessories.

8.2 Exclusions: BABYCHICKATELIER reserves the right not to accept exchanges and returns if the product:

a) It is not part of our stock and has been ordered specifically for the customer;

b) Has been customized;

c) It is sealed and has been opened after delivery;

d) It is not suitable for return for hygiene reasons, after being opened;

e) Has been used or tested;

f) It is on sale;

g) It has already been exchanged previously;

h) If requested after 15 days from the date of receipt.

8.3 How to Exchange or Return

a) For fast and efficient service, the customer must send an email to geral@babychickatelier.com with their identification, email, telephone number, Invoice Number, product reference, indication of the intention to exchange or return, and reason for the exchange/return.

b) After approval, the item must be delivered in person or sent to TALENTOPINION, Lda., Avenida Marquês de Pombal, nº3 r/c loja 8 – 2380-011 Alcanena – and be accompanied by the original purchase document.

c) After receiving the merchandise and checking its status, BABYCHICKATELIER will issue a Credit Note for the product (in case of return) or issue the Credit Note and invoice the correct product (in case of exchange).

d) In case of return, payment will be made by bank transfer, after deduction of shipping costs. The customer must provide their NIB/IBAN. The transfer will be made within 10 business days from the date the return is processed.

e) If the exchange or return occurs due to customer error, the customer will bear the collection and replacement transportation costs, as per the Shipping Table.

f) If the exchange or return is the result of incorrect shipments by BABYCHICKATELIER, the company will bear the shipping and collection costs, provided that the customer communicates the incident within 10 days after receiving the item or on the next business day, if the deadline ends on a Saturday, Sunday or holiday.

g) BABYCHICKATELIER will only accept authorized returns communicated within 10 days of delivery or on the next business day if the deadline ends on a Saturday, Sunday or holiday.

8.4 Conditions for Canceling Orders

a) Customers may cancel their order, provided it has not yet been processed, by sending an email to geral@babychickatelier.com. They must provide the order number, the CPF associated with their registration on the website, and the reason for canceling.

b) Canceled orders will be refunded via bank transfer after the customer and BABYCHICKATELIER have agreed to the cancellation. Payment fees will not be refunded.

c) If the order has already been processed, BABY CHICK ATELIER reserves the right to charge up to 80% of its value in case of cancellation by the customer.

9. Complaints and Suggestions

9.1 BABYCHICKATELIER evaluates and handles customer complaints in accordance with its Quality Management procedures, thus ensuring rigorous monitoring and the pursuit of customer satisfaction.

9.2 BABYCHICKATELIER is not responsible for color variations resulting from partial orders or different batches. For colored items, the customer must order the full quantity required.

9.3 BABYCHICKATELIER does not accept returns of custom-made products, manufactured or purchased exclusively for the customer’s order.

9.4 Returns of other products will only be accepted if communicated within 10 days after delivery or on the first business day thereafter, if the deadline ends on a Saturday, Sunday or holiday, and if they are expressly authorized by BABYCHICKATELIER.

9.5 Complaints must be submitted in writing, including the label information and other product details, to geral@babychickatelier.com. For a faster response, please provide as much information as possible and include a phone number.

10. Agreed Domicile

When contracting with BABYCHICKATELIER, the customer accepts that the address provided is considered legal domicile, and consents to the sending of letters, communications or judicial and extrajudicial notifications to that address.

11. Applicable Law and Competent Court

11.1 The applicable law is Portuguese law.

11.2 For extrajudicial dispute resolution, the buyer may resort to the Conflict Mediation Center, located at CNIACC – National Center for Information and Arbitration of Consumer Conflicts, Faculty of Law of the Universidade Nova de Lisboa, Campolide Campus, 1099-032 Lisbon.

11.3 In the event of legal proceedings, the competent court will be that of the District of Entroncamento, waiving any other.

11.4 These legal procedures and the relevant material will be applied to you or that will not be provided under the General Conditions of Sale.

12. Alteration and Vigilance

12.1 BABYCHICKATELIER reserves the right to change or revoke these Terms and Conditions of Sale unilaterally and without prior notice.

12.2 As disposições destas Condições Gerais de Venda só podem ser alteradas por documento escrito assinado por ambas as partes.
